Terms & Conditions
Dauphin Island Real Estate
1. Property. The property is furnished and includes bath linens, bed linens, fully stocked kitchen with basic essentials, washer and dryer. All units are privately owned. The furnishings and décor will reflect the owners’ tastes and are subject to change.
 
2. Maximum Occupancy: All properties are limited to actual sleeping capacity shown. The minimum age requirement for renting is 25. No sororities, fraternities, house parties, or weddings are allowed. Identification must be furnished upon request. Reservations made under false pretense may be subject to loss of rent and eviction. 
 
3. Terms of the Lease.  The lease begins at 4 p.m. on the check in date and ends at 10 a.m. on the checkout date.  
 
4.  Rental Rules:  Guest agrees to abide by the Rental Rules, listed below at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
 
5.  Access:  Guest shall allow Agent access to the property for purposes of repair and inspection.  Agent shall exercise this right of access in a reasonable manner. Occasionally, a home will come on the market for sale. Our office will contact you to set up an appointment for the showing at a time convenient for you.
 
6. Rental Rate and Fees
  a.       Down Payment:  A down payment of 50% of the total rental is due at the time of booking. A reservation fee of $75 is included in your down payment amount and is NON-REFUNDABLE! 
*If the premises appear dirty or damaged upon Check-in, Guest will inform Agent immediately.  
  b.    Balance: The balance of the rental is due 30 days prior to arrival. For reservations made less than 30 days before arrival, the entire balance is due at the time of the reservation.
 
7. Cancellation Policy:  The Agent requires a 30-day cancellation for condominium rentals, 60 days for house rentals, and 90 days for monthly rentals. Cancellations must be made during regular business office hours (9-5CT). If you give less than minimum notice, your advanced payment will be forfeited to the property owner. All cancellations are subject to a $55 cancellation fee. The reservation fee and the cost of travel insurance are non-refundable. All cancellations must be confirmed with a rental agent. Refunds are issued for cancellations outside of the cancellation date range only.
 
8. Travel Insurance: Dauphin Island Real Estate, Inc. has partnered with RentalGuardian.com and InsureStays to help safeguard your
entire booking deposit and other pre-paid non-refundable payments related to planned travel.
We strongly encourage you to purchase optional travel insurance.
✓ Travel Insurance covers risks incidental to planned travel such as sickness, accidental
injury, or death of you or a family member (or of a traveling companion), weather delays,
natural disasters, unexpected changes in your employment, and many more specified
reasons.
✓ In addition, for an additional charge, you can choose the optional CFAR (cancel for any reason) benefit which pays up to 60% of pre-paid non-refundable charges should cancel for any reason not covered by standard travel insurance.
✓ The standard travel insurance coverage costs 7% of your total reservation invoice
amount; if you include the optional CFAR benefits, the coverage cost is 10.8% of your
total reservation invoice amount. The premium charged for travel insurance is generally
non-refundable after 15 days of coverage purchase.
As a covered traveler, should you have a medical issue or experience trip delay or interruption due to unforeseen developments, you may initiate your claim by calling (833) 610-0736. Guests opting not to purchase travel insurance should be aware that per the terms and
conditions in your rental agreement, refund-in-full of your reservation deposit(s) will not be
available if you are outside of the cancellation timeframe; therefore, your entire booking payment could be at risk. Travel insurance must be purchased before you pay your final balance!
 
 
9. Damage Protection Plan: All reservations will require a $80 damage protection plan
a.     The Vacation Rental Damage plan covers unintentional damages to the rental unit interior that occur during your stay, provided that they are disclosed to the Agent prior to checkout. The protection plan does not cover smoking, unauthorized entry into owner’s closet, excessive cleaning, pet damages, or intentional damage. Any intentional damages will be charged to the credit card on file. The plan will pay a maximum benefit of $500. Please report damages to the rental office. 
 
10. Payment:  We accept cash, echeck, VISA, Discover, MasterCard, and AMEX. Payments for rental can be made online. 
 
11. Internet: Most of the properties have courtesy high-speed DSL or wireless internet. Internet connections on Dauphin Island are generally very good but the Agent cannot assume responsibility and will offer no refunds for outages or slow-downs that may occur. It is the Agents’ recommendations that you bring a hotspot if internet is essential during your stay. Cell Service in Audubon Place, Desoto Landing and Sandcastle Condominiums may not be reliable. Please keep this in mind if you have family or guests trying to reach you. No refunds will be issued for TV outages. 
 
12. Advertisements: Information on the website or on the reservation forms concerning a rental property and its amenities are subject to change without notice. Although every effort is made to keep the website up-to-date and accurate, the Agent is not responsible for omissions or errors. Some units picture cargo lifts. These lifts are restricted to owners use only. Renters are not permitted to use them. If for some unforeseen circumstance your rental property becomes unavailable, the Agent will contact you immediately to discuss alternatives either with Dauphin Island Real Estate, Inc. or with another rental company.
RENTAL RULES
 
1.     Smoking is NOT allowed.  Any evidence of smoking on the premises will result in a penalty of $500. We may charge this amount to any credit card you have put on file or deduct from any deposit you have made to us. 
 
2.     All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Agent is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 
 
3.    Keep the property and all furnishings in good order. Rearranging furniture or removing items from the property is prohibited. Inflatable pools are prohibited. 
 
4.    Only use appliances for their intended uses. 
 
5.    No motor homes or travel trailer hook up. 
 
6.    Pets: Pets are permitted only with prior approval and in designated “pet friendly” units. Prior to arrival, the Pet Addendum must be completed and a pet fee paid. Most units are not pet friendly. Please make sure you are reserving a pet friendly unit BEFORE you book! Unauthorized pets will result in a $500 fine per pet.   If you have any questions about the pet policy of a particular unit, please call us 251-861-8042. Please note, “service animals” are not considered “pets”, and are exempt from the restrictions of this paragraph. 
 
7.    Dauphin Island Beach Rules:
·    Fireworks are prohibited
·    No fires on the beach
·    No motorized vehicles on the beach
·    Authorized pets must be on a leash and picked up after.
**Please stay off of the sand dunes, they help protect our Island. Please turn off exterior lights at night during Sea Turtle nesting season!  
 
8.    Beach equipment and trash must be removed from the beach and property prior to departure. 
 
9.    Housekeeping:  There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate.   We suggest you bring beach towels. We do not permit towels or linens to be taken from the units. If excessive cleaning is needed following Guest departure, the charge will be applied to the credit card on file. 
 
10.    Storms: If there is a named storm with a projected path to the Alabama Gulf Coast and a mandatory evacuation is issued for the South Mobile County/Dauphin Island area during the dates of your stay, you can cancel and receive a full refund of your deposit or you can choose to reschedule your vacation to a future date. 
Refunds are not given due to inclement weather. Refunds are only available where, during your reservation dates, there is a named hurricane or tropical storm with a projected path to the Alabama Gulf Coast and a mandatory evacuation is issued for the South Mobile County/Dauphin Island area by government authorities. . The named hurricane or tropical storm must make landfall during your stay.  Any stay, or part of stay, that occurs after mandatory evacuation is lifted, is not eligible for cancellation or refund.   In the event of a mandatory evacuation, only the unused portion of your stay will be refunded.  
 
11.    Any rental reservation for a home that has a pool, hot tub or spa will require that the execution of a POOL/HOT TUB/SPA WAIVER by all adults who will be staying on the premises. This must be signed before you arrive! Swim diapers required for small children. Any accidents must be reported to the rental agency ASAP. Due to utility conservation guidelines, our pool heaters are designed to maintain heat in cool to moderate temps. Pool heating is optional. The fee is $105. Pool fees will not be pro-rated for un-used days. 
 
12. Dauphin Island Real Estate does not have access to cargo lifts. They are for owners personal use only.

Indemnification & hold harmless
While and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
